Welcome to My Dad's Voice. These Terms & Conditions apply when you access the public website, create an account, subscribe to a plan, or use a My Dad's Voice communication space.
1. Nature of the service
My Dad's Voice is accessible, web-based communication assistance software intended to make everyday communication and digital content easier to reach for people who may have difficulty speaking, typing, using a mouse, or operating conventional interfaces.
2. Accounts, caregivers and authority
- The primary subscriber or caregiver is responsible for managing caregiver PINs, family access and other credentials associated with the communication space.
- You must keep credentials confidential and notify us if you reasonably suspect unauthorised access.
- If you configure a board for another person, upload their personal information or invite family members, you confirm that you have the authority or permission reasonably required to do so, including where the person is a minor or requires assisted decision-making.
3. Acceptable use
You may use My Dad's Voice for personal, family, caregiver or authorised facility-based communication support. You may not:
- Use the service to distribute unlawful, abusive, exploitative or harmful material.
- Attempt to bypass security controls, access another tenant, reverse-engineer protected platform components, or interfere with tenant-isolation barriers.
- Use automated tools to overload, probe or disrupt the service.
- Upload content that you do not have the right to store or share.
4. Fees, trials, billing and subscriptions
- Paid plan pricing, trial periods and feature limits are shown on the pricing/signup pages at the time you subscribe.
- Where recurring billing is enabled, payments are processed by the configured payment provider. My Dad's Voice does not store full payment-card details.
- You may cancel future renewals in accordance with the account controls and payment-provider capabilities available to your subscription.
- Unless otherwise stated, access to paid features continues until the end of the current paid period after cancellation.
- Failed or overdue payments may result in suspension or restriction of paid features after reasonable account handling.
5. Your content and our intellectual property
Your content: you retain ownership of text, recordings, images and documents you or your authorised users provide. You grant the service only the limited rights technically necessary to store, process, back up and display that content within the service.
The platform: the software, interface, design, branding and technology of My Dad's Voice and The Eccles Machine are protected intellectual property of the applicable service operator/developer, except for third-party components used under their own licences. No ownership in the platform software is transferred to subscribers.
6. Availability, compatibility and limitation of liability
My Dad's Voice is provided on an “as-is” and “as-available” basis. We work to provide a reliable service, but cannot guarantee uninterrupted availability, perfect compatibility with every browser, legacy device, speech engine, head-tracking system or eye-gaze configuration, or that every third-party website linked through shortcuts will remain available.
To the maximum extent permitted by law, the service operator/developer is not liable for indirect, incidental or consequential loss arising from use of, or inability to use, the service. Nothing in these terms excludes or limits a right or liability that applicable law does not permit us to exclude or limit.
7. Privacy and data protection
Use of personal information is described in our Privacy Policy. By using the service, you acknowledge that service operation requires processing the information necessary to provide your private communication space, messaging, media, support, billing and security.
8. Suspension and termination
We may restrict or suspend access when reasonably necessary to protect users or infrastructure, respond to unlawful use, investigate a serious security issue, or address a materially overdue account. A subscriber may request account closure and deletion subject to applicable retention, billing and legal requirements.
9. Governing law
These terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of South African courts, subject to any mandatory consumer or data-protection rights that apply.
10. Changes to these terms
We may update these terms as the service, pricing, legal requirements or security controls change. Where a change is material to an active subscriber, we will use reasonable means to provide notice, such as email or an account notice.
